This website is operated by IMBARTS. Throughout the site, the terms “we”, “us” and “our” refer to IMBARTS. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing a product from us (whether via our online checkout or through Instagram Direct Messages), you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

SECTION 1 - PERSONALIZED AND CUSTOM ORDERS

We specialize in custom-made, handcrafted beaded handbags.

Accuracy of Requests: When requesting a custom color palette or custom initials, it is your responsibility to ensure that all letters, spelling, and design specifications provided in the text box or via DM are correct.
Production Initiation: Hand-crafting your custom order will only begin once full payment has been successfully processed and cleared through our payment gateways.

SECTION 2 - NO-REFUND POLICY ON CUSTOM GOODS (CPA COMPLIANCE)

In strict accordance with Section 16 of the South African Consumer Protection Act (CPA), the standard statutory cooling-off return period and "change of mind" exchange policies do not apply to personalized, initialed, or custom-made goods.

Final Sale: All sales for custom colorways or initialed beaded handbags are 100% final. We do not offer cancellations, refunds, or exchanges if you change your mind once production has started or after the item has been delivered.
Damaged or Defective Items: If your handbag arrives structurally defective or was damaged during transit, you must notify us via email or DM within 48 hours of courier delivery. Please include your order number and clear photos of the defect. If validated, we will repair or replace the item at our cost.

SECTION 3 - PRODUCTION LEAD TIMES AND COURIER DELIVERY

Production Timeline: Because our bags are intricately handmade, custom pieces require a standard production timeline of 7-15 business days before dispatch.
Courier Shipping: We ship nationwide across South Africa using third-party door-to-door courier services. Shipping takes an estimated 2 to 4 business days depending on your location (major metros vs. regional areas).
Delays: While we guarantee our production timelines, IMBARTS cannot be held liable for external delivery delays caused by courier service spikes, severe weather, or infrastructure challenges.

SECTION 4 - ONLINE STORE AND INSTAGRAM DM PAYMENTS

Pricing: All prices displayed on our website and quoted in our Instagram DMs are listed in South African Rand (ZAR). Prices are subject to change without notice.
Payment Gateways: Online payments are securely processed via our integrated partners Yoco
DM Orders: For orders finalized in Instagram DMs, payment must be completed via the secure digital payment link provided by us in the chat. We do not accept proof-of-payment screenshots for incomplete EFT transfers; inventory or production slots are only locked in once funds clear.

SECTION 5 - INTELLECTUAL PROPERTY AND HANDMADE NATURE

Copyright Notice: All photography, videography, website designs, and custom brand assets displayed on this website or our social media channels are the exclusive intellectual property of [Insert Your Brand Name].
Handmade Variations: You acknowledge that our products are handcrafted. Minor, non-structural variations in bead alignment, thread tension, or slight color shading are characteristics of unique handmade artisan work and are not considered manufacturing defects.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Republic of South Africa.
